Spousal Sponsorship

Spousal Sponsorship is a vital immigration process that allows Canadian citizens and Permanent Residents to reunite with their foreign national spouses or common-law partners in Canada.

Purpose: Spousal Sponsorship is designed to facilitate the reunification of families by allowing Canadian citizens and Permanent Residents to sponsor their foreign spouses or partners for Permanent Residence in Canada.

Eligibility: To be eligible as a sponsor, you must meet certain criteria, including being a Canadian citizen or Permanent Resident and being at least 18 years old. You must also prove your ability to financially support your spouse or partner and ensure they do not need to rely on government assistance.

Eligibility of the Sponsored Person: The person being sponsored must be either a legally married spouse or a common-law partner (including same-sex partners) who has been living with the sponsor for at least one year. They must also pass medical, criminal, and background checks.

Sponsorship Process:

Application: The sponsor initiates the process by submitting a sponsorship application to Immigration, Refugees, and Citizenship Canada (IRCC).

Assessment: The application is assessed to ensure that both the sponsor and the sponsored person meet the eligibility criteria.

In-Canada vs. Out-of-Canada: Depending on the circumstances, the sponsored person may apply for Permanent Residence from within Canada (In-Canada Class) or from outside Canada (Out-of-Canada Class).

Processing Time: Processing times vary, but IRCC prioritizes the efficient processing of Spousal Sponsorship applications to reunite families as quickly as possible.

Conditional Permanent Residence: Sponsored spouses or partners may initially receive conditional Permanent Residence. After two years, they can apply to have these conditions removed to become full Permanent Residents.

Rights and Responsibilities: As a sponsor, you are responsible for financially supporting the sponsored person for a specified period after they become Permanent Residents. You must also ensure their essential needs, such as food, clothing, and shelter, are met.
